Access injunction: gas safety

Ensuring gas safety is of utmost importance in every residential property. Landlords bear the responsibility of maintaining the suitability and safety of their rental properties for tenants. According to the Gas Safety (Installation and Use) Regulations 1998, landlords are legally obliged to arrange regular maintenance checks by registered engineers for all gas pipe work, appliances, and flues in their rental properties. Additionally, landlords must ensure that an annual gas safety check is conducted by a registered gas engineer. 

Faults or malfunctions in gas appliances pose significant risks to tenants' lives. It is crucial for all properties to be equipped with essential gas safety features, including carbon monoxide alarms. If tenants suspect a problem with any gas appliance or detect a potential gas leak, they should promptly notify the landlord and follow the appropriate safety procedures.

The most significant hazards associated with unsafe gas appliances include gas leaks, fires, and carbon monoxide poisoning.

In the event that your tenant denies access, it is important to inform them that their actions constitute a breach of contract and may result in legal action and potential damages. Take this opportunity to reiterate their legal obligation to grant access for certificates or necessary repairs. If the tenant persists in denying access, it may be necessary to pursue a legal injunction to enforce the contract and gain the required access.
